PARTICIPANT WAIVER OF LIABILITY AND ASSUMPTION OF RISK

I, the undersigned, hereby acknowledge and agree to the following:

1. Voluntary Participation: I am voluntarily participating in Pilates classes, sessions, and/or activities provided by Soleil Pilates LLC. I understand that Pilates involves physical exertion, which may cause injury, including but not limited to muscle strain, sprains, and other physical injuries. I am participating at my own risk.

2. Health and Fitness Condition: I represent that I am in good physical condition and do not suffer from any medical condition that would limit or prevent my safe participation in Pilates activities. If I am not in good physical condition, I have consulted with a physician and received permission to participate in Pilates activities or I have voluntarily chosen to participate without such consultation, assuming all related risks.

3. Assumption of Risk: I understand and acknowledge that participating in Pilates activities may involve inherent risks, including but not limited to the risk of injury, illness, or severe bodily harm. I assume full responsibility for any risks, injuries, or damages, known or unknown, that may occur as a result of my participation.

4. Release of Liability: I hereby release, waive, discharge, and covenant not to sue Soleil Pilates LLC, its owners, instructors, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action that may arise from my participation in Pilates activities. This release includes, but is not limited to, liability arising from negligence or carelessness on the part of Soleil Pilates LLC.

5. Equipment Use: I understand that the use of Pilates equipment, including but not limited to reformers, mats, and accessories, may involve risk. I agree to use all equipment safely and only under the guidance of an instructor. I assume responsibility for any injury or damage caused by improper use of equipment.

6. Children in the Studio: Clients are welcome to bring their children to the studio, where they may use the designated play area adjacent to the workout space and be present in the workout space during my session. However, I understand and agree that I am solely responsible for the safety, behavior, and wellbeing of my child/children while in the studio. Soleil Pilates LLC and its staff are not responsible for supervising children or ensuring their safety.

7. Security Cameras: For the safety and security of all clients, staff, and visitors, the studio is monitored by security cameras. These cameras are in place to document any inappropriate behavior, injuries, or crimes that may occur within the premises. By signing this waiver, I acknowledge and consent to the use of security cameras in common and shared spaces, with footage used solely for health, safety, and legal purposes.

8. COVID-19 and Other Illnesses: I understand that participating in activities in a group setting may increase the risk of contracting illnesses, including COVID-19. I agree to comply with all health and safety guidelines established by Soleil Pilates LLC and assume all related risks.

9. Binding Agreement: This waiver is binding upon my heirs, assigns, and legal representatives. I have read and fully understand the terms of this waiver and agree to be legally bound by them.

If under 18 years of age:

I, the undersigned, state that I am the parent or legal guardian of the individual named below. I understand that the above terms and conditions apply to said minor as well as myself and consent to such terms on behalf of said minor.
